Terms and Conditions for using Akadaplay.

Welcome! AkadaPlay is a platform that streamlines access to precise student data saving time and costs in candidate identification. This promotes fairness, inclusivity, and maximises corporate reward program impact. We have also created a convenient system that allocates and manages how our partners can identify kids who have performed well over a given period and are deserving of scholarships or grants. We hold accurate data on students signed onto our platform, by the government, their school or guardian, regarding their progressive academic performances and can make this information available to our partners in order to assist with their choice of the student(s) to sponsor or for other reasonable reasons. The platform is owned and operated by Akadaplay Technologies Limited (“Akadaplay”, or “we” or “us” or “our”). Winners of prescribed gaming competitions are automatically given a choice between access to digital mediums, cash, or gift prices from varied campaigns (depending on the ongoing campaign or competition) at the end of school sessions. Usage of our platform by non-members is free but limited, as membership is not free. However, membership is free for schools that will sign up as one of our participating schools and allow their students access to our platforms. Each student will be given a unique identification number which is codified with a prefix that has been assigned to the school, to allow for tracking of the performance of a member or its various students. 1. Who is Eligible

To be eligible to use our platform, you must be:
i) a registered educational institution in Nigeria that wishes to become one of our participating schools or;
ii) an individual or organisation willing to become our partner and sponsor a student on one of our reward programs, or;
iii) anyone between the ages of 10 and 17 years, who is a student of a registered education institution in Nigeria (or any other nation). To be able to register to use our platform, you should be between the ages of 10 years and 17 years. You will also need the consent or permission of your parents or legal guardian to complete our registration. We may change these eligibility requirements at any time and reserve the right to refuse membership to any applicant for any reason, at our sole discretion.

2. How do I become a Member?

Membership is on a subscription basis. To become a member, you can visit our registration webpage at www.akadaplay/membership.com. and complete the online application form. During the registration, our system will request personal details such as your name, sex, phone number, school, school identity card, game interest, and email address which will be used to create your account and generate your user login details. For partners, there is an additional option to preregister your payment details or pre-fund an account, as a means of sponsorship.
For Students between the ages of 10 and 17 years, we would require adult consent from either your parents or guardian or via your registered school. You represent that all information provided during registration and throughout your interactions with us is true and accurate. You also agree to update your registered information, as necessary to maintain its truth and accuracy and you are responsible for all activities related to your account and for maintaining the confidentiality of your username and password.

3. Sponsorship, Promotions, Scholarships, & Grants:

Our games are crafted to help kids with their learning outcomes as prepared by the Federal Ministry of Education and this is the general outcome of playing one of our games. In addition, we have competitions for educational institutions where the best-developing kid in an academy session and his/her educational institution stand the chance of winning a grant or any promotion which we run in the session. Where such promotion or grant exists, it will be made known at the beginning of the session, along with any additional terms and conditions

Sponsorships are only available as offers to our partners, who have identified a kid within our platform and are willing to take such a kid through his academic journey by supporting him/her financially. Please see clause 5 below for more information on this. Sponsorship will need to be activated by our partners and may require our partners to pre-fund or link a credit or debit card to their account to settle financial obligations.

4. How do I become a Partner or a Participating School?

Anyone who wishes to sponsor a kid through one of our available routes can reach out to us to be registered as a partner. Our Partnership scheme allows for 3 different levels of partnership based on funds and the number of kids sponsored. All partners will have access to our comprehensive list of kids and institutions on our platform, as well as the performance of the various kids, to help with their selection of kids for sponsorship. On the other hand, any institution can become a participating school and can register with us for free and provide our platform to their registered students for free provided they consent to make available to us, the academy progression of all registered students during the academy session.

5. How do I redeem my Promotions, Scholarships, & Grants:

Each campaign or promotion which we offer during an academy session will specify exactly how the price, scholarship, or grant will be redeemed. You will be contacted by email when you are declared the winner of any promotion or offer. Please also consider the terms displayed along with the campaign or promotion before accepting them. In the event, that there are no terms for redeeming your prize contained in the email, please contact our customer service centre after 3 (three) working days on 07011xxxxx or email us at customerservices@akadaplay.com.

6. Associated Payment Cards:

You are not required to have an Associated Payment Card to be a member, but this would be required for partners. Partners may choose to pre-fund their wallets rather than upload an Associated Payment Card. Accounts that are pre-funded have discounts and additional benefits as contained in our product services. We work with Central Bank of Nigeria registered payment gateway companies to ensure that all cards used within our system are safe. Our system does not store the cvv of any credit/debit card, to further reduce any risk to your card.

7. Can I lose my Promotion or Sponsorship?

Our promotions are normally issued with additional terms and conditions, and it is likely that you can lose a promotion if you do not abide by its terms. The same applies to sponsorships, however, our partners are most likely to dictate the additional terms for sponsorships. Where a promotion or sponsorship is cancelled, you will be issued an email to that effect stating the reasons why the cancellation has occurred. You may be required to refund any sums or items given to you because of the cancellation.

8. Limitations:

There are instances where our games may interact with third-party software or games. We make no representations and bear no responsibility as to the appropriateness or suitability of such games. We also do not warrant or agree to be held liable where a sponsor or partner fails to redeem their obligation towards the students, as we have no control over when they fund their accounts. 

9. How we modify these terms

We may modify these Terms in any manner, at any time, at our sole discretion. We will provide notice of the modification on www.akadaplay.com and by posting the revised Terms on our website and updating the last modified date. Be sure to check our website from time to time to ensure that you are aware of any changes to these Terms. Modifications to these Terms are effective immediately when posted. Except as set forth herein, modifications apply only to activities and disputes that arise after the effective date. Your continued use of our platform after changes have been made to these Terms constitutes your agreement to be bound by the modified Terms. If you do not agree to be bound by the modified Terms, your only recourse is to cancel your membership.

10. Disclaimers

We and our partners make no guarantees, warranties or representations of any kind concerning Akadaplay. Our sponsorship programs or any winning prizes are void where prohibited by applicable laws or regulations, and these Terms are subject to immediate change if necessary to comply with such laws or regulations. You release and hold harmless us, our affiliates, and any participating school or partners from all liability regarding your use of our platform. We make no representations or warranties, either express or implied, including, but not limited to: any implied warranty of quality of education, fitness for intended use or a particular purpose, or those arising by statute or otherwise in law. Our partnership with Participating schools or partners may change at any time, and we may terminate or suspend our relationship with any participating school or partner without prior notice to you. If any term of this agreement is found by a court to be illegal or not enforceable, except as otherwise provided in the Limitations on Arbitration subsection below, all other terms will still be valid and enforceable.

11. Limitation of Liability

Under no circumstances shall we, or any of our affiliates, be liable to you for any indirect, incidental, consequential, special, exemplary or punitive damages, whether any claim is based on warranty, contract, tort (including, without limitation, negligence) or otherwise (even if any of them have been advised of the possibility of such damages). This limitation of liability shall apply however damages arise, including, without limitation, whether such damages are incurred by third parties, and/or whether such damages arise from transactions between you and a partner, your use or misuse of Akadaplay, or the interruption, suspension, or discontinuation of Akadaplay.

12. Governing Law

The law of the Federal Republic of Nigeria governs these Terms and any aspect of your relationship with us. These laws govern without regard to any conflicts of laws principles that would otherwise apply to the substantive law of another jurisdiction.

13. Assignments

Except as expressly set forth herein, you may not sell, assign, or transfer your account or any sponsorship, or any of your rights or obligations under these Terms, whether by operation of law or otherwise. We may sell, transfer, or assign the Akadaplay sponsorship program, in whole or in part, at any time, without notice to you. If we make such an assignment, the sole responsibility for the matters assigned, including any obligations to you, will lie with the party to which we make the assignment, and we will be released from any responsibilities or obligations.

14. Dispute Resolution

For any dispute and as a first point of contact, call our customer service center at customerservice@akadaplay.com or call 07xxxxxxxxxxx to have your issues resolved. If the customer service center is unable to resolve a complaint to your satisfaction, then you may proceed with a claim notice. Before beginning a lawsuit, mediation or arbitration, you and we agree to send a written notice (a “Claim Notice”) to each party against whom a claim is asserted, in order to provide an opportunity to resolve the claim informally. The Claim Notice must describe the claim and state the specific relief demanded. Notice to you may be sent to your email or mailing address. Notice to us must include your name, address and Akadaplay address and must be emailed to complaints@acadaplay.com.

15. Mediation

If arbitration is chosen by any party, neither you nor we will have the right to litigate that claim in court. The Parties must first seek the resolution of such claim by way of negotiation. If the Parties are unable to resolve the dispute by negotiation within 30 days of commencing negotiation, the parties shall refer the dispute to mediation at the Lagos Multi-Door Courthouse (LMDC) in accordance with their rules. The language to be used in Mediation is English Language and the place of the Mediation shall be in Lagos, Nigeria. The agreement reached shall be final and binding on the parties and shall be registered as a Consent Judgement of the High Court of Lagos State.

16. Consent and Withdrawal of Consent Procedure

Consent Procedure

Private owned schools shall be able to demonstrate that the data subject has given explicit consent to the processing of his or her personal data. Where the data subject has given explicit consent to the processing of his or her personal data for online services, and the processing relates to a pupil under 18 years old, additional consent has been received by the person who is the holder of parental responsibility over the pupil. For public schools, the regulatory government agency shall be able to demonstrate that the data subject has given explicit consent to the processing of his or her personal data.

Requesting Consent

Consent must be freely given and the data subject must have a genuine choice as to whether or not they wish to provide their personal data.

Withdrawal Procedure

14.1 Scope:

This procedure addresses your right as a data subject(s) to withdraw consent for the processing of your personal data. Withdrawal of consent by the data subject means an unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies withdrawal of consent to the processing of personal data relating to him or her. Withdrawal of consent by the data subject covers all processing activities carried out for a specific purpose or purposes, for which that data subject provided consent in the first place.  Withdrawal of consent shall not make unlawful any processing of personal data engaged in by AkadaPlay prior to the withdrawal of consent.

14.2 Responsibilities:

As a data controller, AkadaPlay is responsible under the DPA for administering withdrawal of consent from the data subject under advice issued from the Data Protection Officer.

14.3 Withdrawal of consent procedure:

AkadaPlay will acknowledge the data subject has withdrawn consent to the processing of his or her personal data as recorded in the Data Subject Consent Withdrawal Form. Where the processing had multiple purposes, AkadaPlay will demonstrate withdrawal of consent for each purpose as recorded in the Data Subject Consent Withdrawal Form.

14.4 Withdrawal of parental consent procedure:

AkadaPlay will acknowledge the holder of parental responsibility over the specified child has withdrawn consent through the Consent Withdrawal Form.
AkadaPlay will demonstrate that all reasonable efforts have been made to establish the authenticity of the parental responsibility by sighting documentary evidence and through available technology when withdrawing consent for the specified child.
The processing activities that relied upon the consent will be stopped in accordance with the relevant process. The Data Protection Officer will inform the relevant process owner of this change so that processing can be stopped.

14.5 Withdrawal of consent procedure for schools:

Data subjects have the specific right to withdraw consent. Schools are required to inform data subjects about their right to withdraw, and offer them easy ways to withdraw consent at any time. AkadaPlay will acknowledge a partner school’s request to withdraw consent through the Consent Withdrawal Form. The processing activities that relied upon the consent will be stopped in accordance with the relevant process. The Data Protection Officer will inform the relevant process owner of this change so that processing can be stopped.

14.6 Withdrawal of consent procedure for government regulatory body:

AkadaPlay will acknowledge government regulatory body’s request to withdraw consent through the Consent Withdrawal Form.
The processing activities that relied upon the consent will be stopped in accordance with the relevant process. The Data Protection Officer will inform the relevant process owner of this change so that processing can be stopped

17. Data Subject Privacy Right Request Form

Request to Withdraw Consent to the Processing of Personal Data
As a data subject, you have the right to submit a request to withdraw your consent to the processing of their personal data.

If you wish to withdraw consent to the processing of your personal data by us please complete this form and submit it, with proof of identity that you are the Data Subject to customerservices@akadaplay.com.
If you are making the request on behalf of a Data Subject, an authorising letter signed by the Data Subject with proof of the Data Subjects identity must be submitted. Where the data subject is below 18 years, this process can be initiated by parents/guardian.
